ENCOURAGING THE BARANGAYS TO USE THE PORTION OF THEIR BARANGAY CALAMITY FUND ALLOWED BY LAW FOR DISASTER PREPAREDNESS PROGRAM IN ACCORDANCE WITH R.A. 10121

WHEREAS, 5% of the Annual Budget of every Barangay is reserved for calamity fund in accordance with Sec. 21 of Local Government Code of 1991;

WHEREAS, R.A. 10121 (An Act Strengthening the Philippine Disaster Risk Reduction and Management System, Providing for the National Disaster Risk Reduction and Management Framework and Institutionalizing the National Disaster Risk Reduction and Management Plan, Appropriating Funds Therefore and for other Purposes ) allows the use of the calamity fund for programs geared at disaster preparedness and risk reduction which includes early warning system, contingency planning, stockpiling of equipment, coordination, evacuation and public information, and associated training and field exercises;

WHEREAS, the present global and national environment conditions make it imperative that Barangays Institute disaster preparedness and risk reduction program in order to promote the welfare and safety of the people.

WHEREAS, Section 21of R.A. 10121 provides that: “Of the amount appropriated for Local Disaster Risk Reduction and Management Fund (LDRRMF), THIRTY PERCENT (30%) shall be allocated as Quick Response Fund (QRF) or stand-by for relief and recovery programs in order that situations and living conditions of people in communities or areas stricken by disasters, calamities, epidemics, or complex emergencies, maybe normalized as quickly as possible,” hence, practically 70% of the Barangay Disaster Risk Reduction and management Fund may be utilized for the purposed of disaster preparedness and related activities;

         NOW, THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED by the Sangguniang Bayan in session assembled, to encourage, as it is hereby encourages, the Barangays of Bauan, Batangas to use the portion of their calamity fund allowed by law for disaster preparedness programs in accordance with R.A. 10121.

AUTHORIZING HON. RYANH M. DOLOR, MUNICIPAL MAYOR
TO FURTHER NEGOTIATE, ENTER INTO, SIGN AND
EXECUTE ENABLING DOCUMENT WITH
COMNET, THIS MUNICIPALITY
(SPONSOR: HON. NEIL P. VALDEZ)

WHEREAS, Hon. Ryanh M. Dolor, Municipal Mayor submit the attached proposal of COMNET through its President to lease the area to be vacated by the Bauan East Central School and the development and construction of an Integrated Transport Terminal;

WHEREAS, a lease agreement with COMNET on its designate, a land and infrastructure developer would trigger the release of sufficient funds for the construction of school, buildings, other amenities and necessary furniture and equipment for the school; 

WHEREAS, effectively we will be able to accomplish two (2) projects with the proceeds of the lease for one piece of our property;

WHEREAS, an Integrated Transport Terminal will be a major factor in the rationalization of our traffic pattern in the Poblacion and eliminate traffic difficulties hereat;

WHEREAS, relative thereto the undersigned formally request for the passage/ approval of a resolution regarding this matter;

NOW, THEREFORE, BE IT RESOLVED AS IT HEREBY RESOLVED that Draft Resolution No. 11-05-374, Authorizing Hon. Ryanh M. Dolor, Municipal Mayor to further negotiate, enter into, sign and execute enabling Document with COMNET, this Municipality.

CONFIRMING THE AUTHORITY OF HONORABLE MUNICIPAL MAYOR RYANH M. DOLOR, OFFICIAL REPRESENTATIVE OF THE MUNICIPALITY OF BAUAN TO ACCEPT THE DONATION EXECUTED BY METROPOLITAN MANAGEMENT CORPORARTION REPRESENTED BY ITS PRESIDENT GERONIMO F. VELASCO JR., THIS MUNICIPALITY
(SPONSORS: HON. JULIAN C. CASAPAO AND
HON. HERMINIO M. DOLOR)

WHEREAS, the donor, Metropolitan Management Corporation represented by its President Geronimo F. Velasco Jr. donates a parcel of landing favor of the municipality containing 600 square meters, more or less, covered by TCT No. T-158374;

WHEREAS, said parcel of land is situated in the Barangay of Sto. Domingo, Municipality of Bauan, Province of Batangas, Island of Luzon, and the Donee shall develop the property into a basketball Court pursuant to such design and specification as the donor may prescribe;

WHEREAS, the donor in consideration of its philanthropic desire to help and contribute to the good and welfare of the donee and its constituents, has decided to donate the property to the condition as here often provided;

WHEREAS, the donee has agreed to accept the donation of the property by way of Donation in favor of the Donee, free from all liens and encumbrances;

WHEREAS, the donee hereby accepts the donation to it of the Property and agrees to fully comply, at its own expense, subject of the Deed of Conditional Donation, made and entered into by and between Metropolitan Management Corporation represented by its President Geronimo F. Velasco Jr., and Municipality of Bauan, Batangas represented by Honorable Municipal Mayor Ryanh M. Dolor, signed in the presence of two witnesses;

NOW, THEREFORE, BE IT RESOLVED AS IT HEREBY RESOLVED by the Honorable Members of Sangguniang Bayan to approve resolution confirming the authority of Honorable Municipal Mayor Ryanh M. Dolor, official representative of the Municipality of Bauan to accept the donation executed by Metropolitan Management Corporation represented by its President Geronimo F. Velasco Jr., this Municipality.

DECLARING STATE OF CALAMITY FOR THE ENTIRE
MUNICIPALITY OF BAUAN
(SPONSOR: HON. JULIAN C. CASAPAO)

WHEREAS, the DSWD Disaster Response, Operations, Monitoring and Information Center Bauan, Batangas and Office of the Municipal Health Officer submitted written report to Honorable Mayor Ryanh M. Dolor about the damage brought by the heavy rain and flood to various barangays of the Municipality of Bauan;

WHEREAS, the following are list of the affected barangays:

1.     Aplaya                        6. San Pedro
2.     New Danglayan            7.  San Andres
3.     San Roque                  8.  Poblacion II
4.     Sto. Domingo              9.  Sta. Maria
5.     San Andres Proper       10. Manghinao Proper

WHEREAS, 202 families (942 persons) were been affected, 51 house destructed and 11 houses damaged, and also Infrastructure damage happened particularly bridges, sea wall and roads of the said barangays;

WHEREAS, 20% of the total numbers of our 40 barangays were been affected and it is legal for the undersigned to declare the entire Municipality of Bauan under State of Calamity;

WHEREAS, the reports taken by the DSWD Disaster Response, Operations, Monitoring and Information and the Office of the Municipal Health are attached herewith;

WHEREAS, relative thereto this author formally request for the passage/ approval of a resolution regarding this matter;

NOW, THEREFORE, BE IT RESOLVED AS IT HEREBY RESOLVED that Draft Resolution No. 11-06-383, Declaring State of Calamity for the entire Municipality of Bauan.
