GRANTING AUTHORITY TO THE HON. RYANH M. DOLOR, MUNICIPAL MAYOR TO ENTER INTO A CONTRACT WITH A CONSULTANT THAT WILL GUIDE THE MUNICIPAL PLANNING AND DEVELOPMENT COORDINATOR (MPDC) IN THE PREPARATION OF CLUP, CDP, AND SOLID WASTE MANAGEMENT PLAN, THIS MUNICIPALITY

WHEREAS, the Committee on Engineering, Infrastructure, Public Works and Land Use under the chairmanship of Hon. Julian C. Casapao held a meeting last March 31, 2011 regarding Draft Resolution No 11-04-368;

WHEREAS, in the said Committee Meeting, they revealed that the matter regarding the need to hire a consultant will guide the Municipal Planning and Development Coordinator (MPDC) in the preparation of Comprehensive Land Use Plan, CDP and Solid Waste Management Plan is a valid request;

WHEREAS, the committee want to grant the Municipal Mayor the authority to enter into a contract with a consultant on the said matter;

WHEREAS, relative thereto, the undersigned respectfully request for the passage/ approval of a resolution regarding this matter;

NOW, THEREFORE, BE IT RESOLVED AS IT HERBY RESOLVED by this council to grant authority to the Hon, Ryanh M. Dolor, Municipal Mayor to enter into a contract with a consultant that will guide the Municipal Planning and Development Coordinator (MPDC), in the preparation of CLUP, CDP, and Solid Waste Management Plan, this Municipality.

AUTHORIZING THE MUNICIPAL MAYOR RYANH M. DOLOR TO ENTER INTO A MEMORANDUM OF AGREEMENT (MOA) WITH THE DEPARTMENT OF THE INTERIOR AND LOCAL GOVERNMENT-CALABARZON (DILG-IVA)

HON. JEROME ALVIN B. MONILLA AND HON. JULIAN C. CASAPAO)

WHEREAS, section 444 (b) (VI) of the Local Government Code (LGC) of 1991, provides that upon authorization of the Sanggunian the local Chief Executive may represent the municipality to sign on its behalf, contracts and such other documents made pursuant to law or ordinances;

WHEREAS, due to recent economic recessions and relentless oil increases, the government recognizes the effect and vulnerability of the public transport particularly the tricycle operators;

WHEREAS, the Office of the President issued Executive Order No. 32, S 2011, which created the Public Transport Assistance Program (PTAP) as an urgent intervention aimed at cushioning the impact of high fuel prices on the marginalized sectors of society;

WHEREAS. Under PTAP, it shall subside a portion only of their average fuel consumption as a means of reducing the impact of uncontrollable fuel increase;

WHEREAS, pursuant to the said Executive Order and its implementing Rules and Regulation, the Department of the Interior and local Government, was tasked to coordinate with the Municipal Governments in the implementation of PTAP which grants financial assistance to qualified tricycle franchises as provided thereof;

NOW, THEREFORE, BE IT RESOLVED AS IT HEREBY RESOLVED by the Honorable Members of the Sangguniang Bayan to authorize the Municipal Mayor Ryanh M. Dolor to enter into a Memorandum of Agreement for the purpose of but not limited to:

1. Cause the preparation and certification of a complete List of Tricycle Franchises with addresses and number of operating units with valid franchise as of March 31, 2011;
2. Cause the posting of the certified List of Tricycle Franchisees, Addresses, Franchise Numbers and Number of Operating Tricycles in publicly accessible and conspicuous places with local government-owned buildings;
3. Transmit to the DILG Regional Office, through the Municipal Local Government Operations Officer, a copy of the above-mentioned Certified List as basis in the computation of the Tricycle Transport subsidy;
4. Upon receipt of the sub-allotment and Notice of Transfer of cash Allocation (NTCA), cause the immediate issuance of an Official Receipt (OR) to DILG Regional office-CALABARZON, acknowledging the tricycle transport financial subsidy;
5. Direct the concerned Municipal Officials or employees to attend the coordination meeting with the DILG Municipal Local Government Operations Officer to firm up administrative preparations for the scheduled financial subsidy distribution;
6. Conduct Information and Education Campaign (IEC) to all tricycle franchises and other person of interested groups as to the date, venue and distribution scheme of the funds;
7. Devise a system to ensure the integrity of fund disbursement of tricycle franchisees, as well as to effect an organize and orderly distribution of the financial assistance to all franchises based ONLY ON THE CERTIFIED LIST OF TRICYCLE FRANCHISEES;
8. To allocate funds in the effective and efficient implementation as stated above, and to provide administrative and logistical support.”

APPROVING THE APPOINTMENT OF ATTY. BIENVINIDO C. CASTILLO AS SPECIAL CONSULTANT ON LOCAL GOVERNMENT AFFAIRS IN THE OFFICE OF THE MUNICIPAL MAYOR FOR THE PERIOD FROM MAY 16 – DECEMBER 31, 2011, THIS MUNICIPALITY
(SPONSOR: HON. HERMINIO M.  DOLOR)

WHEREAS: Mr. Alfredo L. Dimaunahan, Administrative Officer V from Human Resource Management Office send a request letter to Hon. Juan M. Magboo, Presiding Officer dated May 5, 2011 regarding Draft Resolution No. 11-05-372;

WHEREAS: Atty. Bienvinido C. Castillo will be appointed as Special Consultant on Local Government Affairs in the Office of the Municipal Mayor for the period from May 16 – December 31, 2011 in consideration of his monthly rate of P17,000.00 to be paid every 30th day of the month;

WHEREAS: The following are the duties and responsibilities to be perform by Atty. Bienvinido C. Castillo as a Special Consultant on Local Government Affairs:
Provide professional advice on matter that relate to administrative problems as well as those that concern local government affairs, guide from consultation on legal matters and other allied problems that  beset the municipality.

Performs work at a time and schedule and maybe consulted either by phone or any line of communications at anytime, should the urgent necessity therefore arises in relation to the discharge of such functions.

WHEREAS: Attached herewith are the educational background and working history and experience of Atty. Bienvinido C. Castillo;

WHEREAS: Relative thereto the undersigned respectfully request for the passage /approval of a resolution regarding this matter;

       NOW, THEREFORE, BE RESOLVE AS IT IS HEREBY RESOLVED that Draft Resolution No. 11-05-372, approving the appointment of Atty. Bienvinido C. Castillo as Special Consultant on Local Government Affairs in the Office of the Municipal Mayor for the period from May 16 – December 31, 2011 be approved by the Sangguniang Bayan Members, this municipality.

AUTHORIZING THE MUNICIPAL MAYOR HONORABLE RYANH M. DOLOR TO ENTER INTO A MEMORANDUM OF AGREEEMENT WITH CAJ INFORMATION SOLUTIONS FOR THE COMPUTERIZATION OF POLICE CLEARANCE
AND IDENTIFICATION SYSTEM IN THE OFFICE OF PNP-BAUAN
(SPONSOR: HON NEIL VALDEZ)

WHEREAS, the computer services of CAJ Information Solutions have converted Police records into electronic records through their copyright program concerning the Police Clearance and Identification System and already being appreciated by several key cities around the country;

WHEREAS, said system involves the computerized processing of information by and between the police clearance applicant’s record and the police station’s criminal and derogatory records;

WHEREAS, CAJ Information Solutions have offered and presented before the Sangguniang Bayan a computer system which will provide a task and efficient service for the benefit of the constituents of the municipality and at no cost to the government;

WHEREAS, the above-named company shall continue to provide and install the necessary computer, equipped with video camera and necessary software together with a proficient computer technician who will operate the system;

NOW, THEREFORE, after careful screening and review of CAJ’s Company profile and intentions on a motion duly seconded;

BE IT RESOLVED, AS IT IS HEREBY RESOLVED, authorizing the municipal Mayor Hon. Ryanh M. Dolor to enter a Memorandum of Agreement with CAJ Information Solutions for the Computerization of Police Clearance and Identification System in the office of PNP-Bauan
