Approving the Issuance of
LocationAL Clearance and Development Permit of Atlantic Gulf
and Pacific Company of Manila Inc. (AG&P) for the Land Development
containing an area of ONE HUNDRED SIXTY-SEVEN THOUSAND SEVEN HUNDRED AND NINETY-THREE SQ. M.
(167,793 SQ. M.) situated at Barangay Manghinao
Proper and San Andres PROPER, Bauan,
Batangas, this Municipality

Whereas,
Engr. Melvin B. Arevalo, OIC-MPDC Zoning Administrator sent a letter request to
Hon. Juan M. Magboo, Vice Mayor and SB Presiding Officer dated April 19, 2012;
Whereas,
OIC-MPDC and Zoning Administrator is requesting for the issuance of Locational
Clearance and Development Permit of Atlantic Gulf and Pacific Company of Manila
Inc. (AG&P) for the Land Development situated at Barangay Manghinao Proper
and San Andres Proper, Bauan, Batangas;
Whereas,
the said land development contain an area of One Hundred Sixty-Seven Thousand
Seven Hundred and Ninety-Three sq. m. (167,793 sq. m.);
Whereas,
the said land was classified as Industrial as per Sangguniang Bayan Ordinance
No. VIII, Series of 1995 approved under Sangguniang Panlalawigan Resolution No.
058, Series of 1996 and Sangguniang Bayan Ordinance No. 12-03-0486, Series of
2012 approved under Sangguniang Panlalawigan Resolution No. 053, Series of
2012;
Whereas,
relative thereto this august body respectfully request for the passage/approval
of a resolution regarding this matter;
Now,
therefore, be it resolved as it is hereby resolved, that Draft
Resolution No. 12-07-562, Approving the Issuance of Locational Clearance and
Development Permit of Atlantic Gulf and Pacific Company of Manila Inc.
(AG&P) for the Land Development containing an area of One Hundred
Sixty-Seven Thousand Seven Hundred and Ninety-Three sq. m. (167,793 sq. m.)
situated at Barangay Manghinao Proper and San Andres Proper, Bauan, Batangas be
approved by the Sangguniang Bayan Members, this Municipality.

RESOLUTION

AUTHORIZING THE MUNICIPAL MAYOR, HON. RYANH M. DOLOR TO NEGOTIATE,
ENTER INTO, SIGN AND EXECUTE A MEMORANDUM OF AGREEMENT UNDER THE PUBLIC PRIVATE PARTNERSHIPS PROGRAM WITH THE
BEST PROPONENT THAT CAN LEASE
AND DEVELOP THE MUNICIPALITY’S PLAZA RECTO
INTO A MULTI
LEVEL COMMERCIAL
CENTER
(SPONSORS: HON.
WILLIAM C. ABRAHAN and HON. NEIL P. VALDEZ)
WHEREAS, this council is fully aware of
the need for the Municipality
of Bauan to generate more
income in order to defray expenses and funding for health, infrastructure,
educational, and social projects of this Local Government Unit to the end that
the people of Bauan in general will have been benefited;
WHEREAS, this council is also cognizant
that Plaza Recto which was formerly a seat for Basketball tournaments and other
activities has become idle taking into account the transfer to other sites of
the many events and activities of the Municipal Government;
WHEREAS, seeing that Plaza Recto can be
more income generating and productive by developing it into a multi level
commercial center, this council which desires for investment inviting center in
the heart of Bauan is more than willing to make it a reality and to express
support for the chief executive to study the possibility of entertaining
unsolicited proposals to develop the area;
WHEREAS, since Comnet Management
Corporation has manifested its intention to lease and develop Plaza Recto into
a multi level commercial center through its letter to the Municipal Mayor which
was transmitted to the Office of the Sangguniang Bayan on July 4, 2012, this
council, trusting the wisdom of the Municipal Mayor in weighing the proposal of
Comnet and other proposals that may still come, is in favor to grant him the
necessary authority for this purpose;
WHEREAS, in giving such authority, this
council is confident that all qualifications and none of the disqualifications
of the proponents including the strict observation of all legal processes and
the usual pre-audit and audit system whichever is applicable in the subject
negotiation and in the execution of the Memorandum of Agreement (MOA) or
similar instruments shall always be considered by the parties involved
otherwise it will render said MOA as invalid even before it seeks ratification
of and by the Sangguniang Bayan;
NOW, THEREFORE, CONSIDERING THE FOREGOING,
be it resolved as it is hereby resolved by this august body to grant the
Honorable Municipal Mayor Ryanh M. Dolor an authority to negotiate, enter into,
sign and execute a Memorandum of Agreement or similar instruments under the
Public Private Partnership Program with the best proponent that can lease and
develop the Municipality’s Plaza Recto into a Multi Level Commercial Center;
RESOLVED, FURTHER, that the herein
subject Memorandum of Agreement (MOA) or similar instruments signed and
executed by the Municipal Mayor with the chosen proponent shall be ratified by
the Sangguniang Bayan in order to complete the process and to render the MOA
valid and effective otherwise said MOA or similar instruments shall be
considered as null and void from the beginning

WHEREAS, a letter request was sent to Hon.
Juan M. Magboo, Presiding Officer of Sangguniang Bayan thru Mr. Ferdinand M.
Agena, SB Secretary dated July 25, 2012;
WHEREAS, the boundary dispute between
the Municipality
of Bauan and San Pascual
remains unresolved for almost four (4) decades;
WHEREAS, thru the initiative of Board
Member Florencio A. De Loyola, several meeting were held among official
concerned to look for a final solution to the lingering problem which has
affected the relationship between the two municipalities;
WHEREAS, after consultations and
dialogue among the two municipalities a consensus was reached for an amicable
settlement to resolve the issue to the satisfaction of the contending parties;
WHEREAS, relative thereto the Local
Chief Executive respectfully request for the passage/approval of a resolution
regarding this matter;
NOW, THEREFORE, BE IT RESOLVED AS IT IS
HEREBY RESOLVED, that Draft Resolution No. 12-07-572, Authorizing Honorable
Municipal Mayor, Ryanh M. Dolor, to enter into an amicable settlement and sign
in behalf of Bauan, Batangas regarding the boundary dispute with the

WHEREAS, Hon. Ryanh M. Dolor, Municipal
Mayor sent a letter request to Hon. Juan M. Magboo, Presiding Officer,
Sangguniang Bayan through Mr. Ferdinand M. Agena, SB Secretary dated July 26,
2012 about Draft Resolution No. 12-07-574;
WHEREAS, our loan application with the
Development Bank of the Philippines (DBP) for the construction of a new municipal
building was approved in principle but release of the funds was suspended
pending submission of the seal of good housekeeping to be issued by the
Department of Interior and Local Government (DILG);
WHEREAS, the local committee on good
housekeeping is exerting its best effort to complete all requirements in
support our securing the needed approval of the DILG;
WHEREAS, at this juncture and to hasten the
construction of the new municipal building, we deem it necessary to look for
other financial organization that can grant us loan under the same condition as
that of the DBP until such time that DBP would be able to effect the release of
our loan with them;
WHEREAS, relative thereto, this august body
respectfully request for passage/approval of a resolution regarding this
matter;
NOW, THEREFORE, BE IT RESOLVED AS IT
IS HEREBY RESOLVED,
that Draft Resolution No. 12-07-574, Authorizing Hon. Ryanh M. Dolor, Municipal
Mayor to negotiate and enter into an agreement with other financial
organization who can provide bridge financing for the construction of New
Municipal Building be approved by the Sangguniang Bayan Members, this
municipality.
