APPROVING THE APPLICATION OF PRELIMINARY APPROVAL AND LOCATIONAL CLEARANCE (PALC) AND DEVELOPMENT PERMIT BY AMAIA LAND CORP. FOR THE LAND DEVELOPMENT OF AMAIA 
SCAPES BAUAN WITH A TOTAL LAND AREA OF 110,934 SQ.M. 
SITUATED AT BRGY. AS-IS, BAUAN, BATANGAS
(SPONSORS: HON. WILLIAM C. ABRAHAN,
HON. JULIAN C. CASAPAO and HON. NEIL P. VALDEZ)

WHEREAS, section 447 (2) (X) of the Local Government Code of 1991 provides that it is the duty and within the power of the Sangguniang Bayan to process and approve subdivision plans for residential, commercial, industrial and other development purposes;

WHEREAS, considering the request for preliminary approval and locational clearance of AMAIA Scapes Bauan, this august body assigned the matter to the proper committees last June 01, 2012 for review and proper study;

WHEREAS, this subdivision development will be of help to BatangueƱos and to the Government of Bauan in its desire to pursue the sustainable development in Bauan;

NOW, THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED by the Honorable Members of the Sangguniang Bayan to approve the application for preliminary approval and locational clearance by AMAIA Land Corp. for the land development of AMAIA Scapes Bauan with a total land area of 110,934 sq.m. situated at Brgy. As-is, Bauan, Batangas.

AUTHORIZING HON. RYANH M. DOLOR, MUNICIPAL MAYOR TO ENTER INTO AND SIGN THE MEMORANDUM OF AGREEMENT WITH THE DEPARTMENT OF AGRICULTURE FOR THE CONCRETING OF 
FARM TO MARKET ROAD IN BARANGAY ALAGAO AND 
BARANGAY SAN VICENTE, THIS MUNICIPALITY
(SPONSOR: HON. JULIAN C. CASAPAO)

WHEREAS, Hon. Ryanh M. Dolor, Municipal Mayor sent a letter request to Hon. Juan M. Magboo, Vice Mayor and Presiding Officer, Sangguniang Bayan, through Mr. Ferdinand M. Agena, SB Secretary dated June 15, 2012 about Draft Resolution No. 12-06-550;

WHEREAS, the Department of Agriculture has allocated Seven Million Five Hundred Thousand Pesos (P7,500,000.00) for the concreting of farm to market road in Barangay Alagao and the same amount also for the concreting of Barangay San Vicente farm to market road;

WHEREAS, other requirements have been prepared for submission to the Department of Agriculture;

WHEREAS, required also is the authority of the Local Chief Executive to enter into a Memorandum of Agreement with the Department of Agriculture for the implementation of the 2 projects which will benefit our constituents in their barangay;

WHEREAS, relative thereto the Local Chief Executive respectfully request for the approval of a resolution authorizing him to enter into and sign a Memorandum of Agreement with the Department of Agriculture to facilitate the completion of the above-mentioned project;

NOW, THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED, that Draft Resolution No. 12-06-550, Authorizing Hon. Ryanh M. Dolor, Municipal Mayor to enter into and sign the Memorandum of Agreement with the Department of Agriculture for the concreting of farm to market road in Barangay Alagao and Barangay San Vicente be approved by the Sangguniang Bayan Members, this municipality.

WHEREAS, Hon. Ryanh M. Dolor, Municipal Mayor sent a letter request to Hon. Juan M. Magboo, Presiding Officer, Sangguniang Bayan through Mr. Ferdinand M. Agena, SB Secretary dated June 20, 2012 about Draft Resolution No. 12-06-551;

WHEREAS, our loan application with the Development Bank of the Philippines (DBP) for the construction of a new municipal building was approved in principle but release of the funds was suspended pending submission of the seal of good housekeeping to be issued by the Department of Interior and Local Government (DILG);

WHEREAS, the local committee on good housekeeping is exerting its best effort to complete all requirements in support our securing the needed approval of the DILG;

WHEREAS, at this juncture and to hasten the construction of the new municipal building, we deem it necessary to look for other financial institution that can grant us loan under the same condition as that of the DBP until such time that DBP would be able to effect the release of our loan with them;

WHEREAS, relative thereto, this august body respectfully request for passage/approval of a resolution regarding this matter;

NOW, THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED, that Draft Resolution No. 12-06-551, Authorizing Hon. Ryanh M. Dolor, Municipal Mayor to negotiate and enter into an agreement with other financial institutions who can provide bridge financing for the construction of New Municipal Building be approved by the Sangguniang Bayan Members, this municipality.

RECLASSIFICATION OF LANDS OWNED BY THE ATLANTIC GULF
AND PACIFIC COMPANY OF MANILA INC., (AG&P) FROM AGRICULTURAL AND BUILT-UP TO INDUSTRIAL USE WITH A TOTAL LAND AREA OF FORTY-FIVE THOUSAND THREE HUNDRED AND SEVENTY-FOUR POINT FIVE SQUARE METERS (45,374.5 SQ.M)
(SPONSORS: HON. WILLIAM C. ABRAHAN,
HON. JULIAN C. CASAPAO and HON. NEIL P. VALDEZ)

WHEREAS, the Sangguniang Bayan had approved the Comprehensive Land Use Plan (CLUP) by way of Resolution No. 139 Series of 2002 on July 2, 2002;

WHEREAS, this council is fully aware that any move by any concerned party to make use of lands for uses other than what was stipulated in the CLUP shall require action by the Sangguniang Bayan so that subject lands can be reclassified into other intended use;

WHEREAS, the attached certification by the Municipal Planning and Development Coordinator dated May 25, 2012 as to the lands of AG&P that require action by this august body is proof of the total land area of lots owned by AG&P that needs to be reclassified;

 WHEREAS, this august body after having delligently evaluated the merits of the  herein subject reclassification of lands owned by AG&P in consideration also of the certification issued to the Sangguniang Bayan by the MPDC resolves to pass the approval of the herein subject reclassification;

NOW, THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED by the Honorable Members of the Sangguniang Bayan to reclassify the lands owned by the Atlantic Gulf and Pacific Company of Manila Inc., (AG&P) from Agricultural and Built-up to Industrial use with a total land area of Forty-Five Thousand Three Hundred and Seventy-Four Point Five Square Meters (45,374.5 sq.m)
