AUTHORIZING THE HONORABLE MAYOR RYANH
M. DOLOR TO ACCEPT THE DEED OF DONATION OVER A PARCEL OF LAND UNDER TCT NO.
T-116852 EXECUTED
BY THE HEIRS OF JOSE A. BRUAL

HON. JULIAN C. CASAPAO )
WHEREAS, copy of Deed of Donation over a
parcel of land under TCT No. T-116852 have been endorsed to the Office of the
Mayor by Margarita O. Brual, widow of Jose A. Brual, Maryrose O. Brual,
married, Reynaldo O. Brual, single, Ma. Cristina O. Brual, single, and
Renato O. Brual, married, all of legal age, Filipinos and residents of Poblacion
II, Bauan, Batangas;
WHEREAS, on March 13, 2012, Hon. Mayor Ryanh
M. Dolor presented to the Office of the Sangguniang Bayan the aforetitled Deed
of Donation;
WHEREAS, the size of the said parcel of land
under TCT No. T-116852 is ONE THOUSAND FIVE HUNDRED THIRTY TWO SQUARE METERS
(1,532 sq.m.);
WHEREAS, the very purpose of the said deed of
donation according to the proposal and reconfirmed by the Hon. SB Member Julian
C. Casapao is for the Municipality’s strategic road network;
WHEREAS, cognizant of the copy of the
foregoing Deed of Donation, this august body in session assembled hereby
decides to authorize the Honorable Municipal Mayor to accept the aforetitled
Deed of Donation for the purpose of road network;
NOW, THEREFORE, BE IT RESOLVED AS IT
IS HEREBY RESOLVED,
by the Honorable Members of the Sangguniang Bayan to pass a resolution
authorizing the Honorable Mayor Ryanh M. Dolor to accept the Deed of Donation
over a parcel of land under TCT No. T-116852 executed by the heirs of Jose A.
Brual.

EXPRESSING OPPOSITION TO THE
APPLICATION OF AQUA DATA INC. FOR THE ISSUANCE OF A CERTIFICATE OF PUBLIC
CONVENIENCE
TO OPERATE AND MAINTAIN A WATERWORKS
SYSTEM IN
THE MUNICIPALITY OF BAUAN,
BATANGAS
(SPONSOR: HON. WILLIAM C. ABRAHAN)
WHEREAS, Hon. Ryanh M. Dolor, Municipal
Mayor, sent a letter request to Hon. Juan M. Magboo, Vice Mayor and SB
Presiding Officer, thru Mr. Ferdinand M. Agena, SB Secretary, dated May 22,
2012;
WHEREAS, the Local Chief Executive forwarded
to the SB Office a copy of letter dated Feb. 17, 2012 to the National Water
Resources Board regarding the opposition to the application of Aqua Data Inc.
(Case No. 11-1580) for the Issuance of a Certificate of Public Convenience to
operate and maintain a waterworks system in the Municipality of Bauan,
Batangas;
WHEREAS, a hearing was called last April 26,
2012 but was postponed due to the absence of the representative of Aqua Data
Inc. according to our counsel, Atty. Bienvenido C. Castillo;
WHEREAS, Aqua Data Inc. was only managing
and operating the Bauan Municipal Waterworks System (BMWS) facilities of the
Municipality with a contract which was pre-terminated by mutual agreement of
the parties on Jan. 11, 2011 to give way to the total disposal of the system
subject to public bidding and under auditing rules and regulations;
WHEREAS, relative thereto, the undersigned
respectfully request for the passage/approval of a resolution regarding this
matter;
NOW, THEREFORE, BE IT RESOLVED AS IT
IS HEREBY RESOLVED that
draft resolution no. 12-05-530, Expressing Opposition to the Application of
Aqua Data Inc. for the Issuance of a Certificate of Public Convenience to
operate and maintain a waterworks system in the Municipality of Bauan,
Batangas, be approved by the Sangguniang Bayan Members, this municipality.

RECLASSIFYING FROM AGRICULTURAL TO
RESIDENTIAL A TOTAL LAND AREA OF ONE HUNDRED TEN THOUSAND ONE HUNDRED FORTY

WHEREAS, the Sangguniang Bayan had passed
the approval of the Comprehensive Land Use Plan (CLUP) of this municipality by
virtue of Resolution No. 139 dated July 2 series of 2002;
WHEREAS, the Sangguniang Panlalawigan by
virtue of Resolution No. 212, dated July 4, 2003 ratified the aforesaid CLUP of
the Municipality
of Bauan;
WHEREAS, in the CLUP, the aforetitled area
of land is classified as agricultural which requires reclassification by this
august body if subject land is to be used for residential purpose;
WHEREAS, this council is fully aware that the
purpose of this reclassification is for AMAIA LAND
to develop a residential subdivision in the subject barangay;
WHEREAS, subject application for
reclassification has been endorsed by the Office of the Municipal Planning and
Development Coordinator on May 24, 2012 for immediate review and consideration
of the Sangguniang Bayan;
NOW, THEREFORE, BE IT RESOLVED AS IT
IS HEREBY RESOLVED by
the Honorable Members of the Sangguniang Bayan to reclassify from agricultural
to residential a total land area of ONE HUNDRED TEN THOUSAND ONE HUNDRED FORTY
EIGHT SQUARE METERS (110,148 SQM) in Barangay As-is of this municipality as
applied for by AMAIA LAND CORPORATION of 10F Ayala Life FGU, Zapote Rd.,
Muntinlupa City.

APPROVING THE SUPPLEMENTAL ANNUAL INVESTMENT PLAN (AIP) FOR CALENDAR
YEAR 2012, THIS MUNICIPALITY

WHEREAS, Engr. Melvin B. Arevalo, OIC
Municipal Planning and Development Coordinator and Zoning Administrator
formally endorse the copy of Supplemental Annual Investment Plan (AIP) for
Calendar Year 2012 to Hon. Juan M. Magboo, Vice Mayor and SB Presiding Officer
thru Mr. Ferdinand M. Agena, SB Secretary dated May 29, 2012, for guidance and
ratification;
WHEREAS, the Municipal Development
Council with Hon. Mayor Ryanh M. Dolor, Chairman MDC, held a special meeting at
Audio Visual Room, Bauan Technical High School on May 28, 2012 about the
approval of AIP 2012 of Bauan;
WHEREAS, the Local Chief Executive
stressed the importance of this undertaking and mentioned that programs and
projects in the barangay as well as in the municipal level should be included
in the AIP so that those projects maybe implemented;
WHEREAS, the Supplemental AIP 2012 has been presented by the OIC of MPDC and the
program/projects/activities that were presented and deliberated upon are
attached herewith;
WHEREAS, after the deliberations,
Municipal Budget Officer, Magdalena Subibi, move for the approval of the
Supplemental AIP 2012 as submitted, discussed and amended;
WHEREAS, then having no objection heard
from the body, the Municipal Development Council of Bauan assembled therein,
unanimously approved the Supplemental at AIP 2012;
WHEREAS, relative thereto, this august body respectfully respect
for the passage/ approval of a resolution regarding this matter;
NOW, THEREFORE, BE IT RESOLVED AS IT IS
HEREBY RESOLVED that Draft Resolution No. 12-06-538, Approving the
Supplemental Annual Investment Plan (AIP) for Calendar Year 2012, be approved
by the Sangguniang Bayan Members, this Municipality.
